Federal Historic Preservation's "Place" in Property Theory

Progressive Property Theory scholars often point to historic preservation as an example of how property, itself, imposes obligatory use. A structure’s public benefit justifies restrictions in available uses. To date, however, has considered only it is applied state and local regimes, forgoing analysis the federal structure under National Historic Preservation Act. This article establishes a synergy between underlying principles suggests that preservation’s identification incentivization structures model process could move toward wider applications.
